Contract BILL OF SALE CONTRACT This contract is for the sale of a male/female Schipperke puppy, and is legal and binding between the original purchaser and breeder of the puppy. The purchaser, ____________________, agrees to pay $____, in U.S. funds. Both the purchaser and the breeder, _____________________, agree to the following terms. At the time of sale the puppy is ________ old. It can be identified by this microchip number: _____________________. The puppy's registered AKC number is: _____________________________. The puppy's registered name will be: _____________________________. The puppy is sired by __________________________, whose AKC number is: _______________________; and is out of _________________________, whose AKC number is: ____________________________. 1. The purchaser will take the puppy to their vet within three days of obtaining the dog for a complete health check. If this requirement is not met, then the health guarantees in this contract are null and void. The name, address and phone number of the puppy's vet will be given to the breeder by the purchaser. 2 The puppy will be spayed or neutered, and the pup will never be bred. If the dog is bred without the breeder's knowledge and written permission, the purchaser agrees that the breeder has to right to "self-help" and can come and get the dog and all of its puppies, and the breeder will take the dog home with them on that day. 3. If the purchaser at any time can no longer care for the dog, they will return the dog to the breeder. The breeder will either at that time sell the puppy on behalf of the purchaser for a reasonable price, or place the puppy in a good home. The purchaser has the option of contacting and speaking to any possible new home for the puppy. If the purchaser does sell or give the dog to anyone other than the breeder, the breeder retains the right to "self-help", and can go and get the dog from that person, and the purchaser is responsible for any legal ramifications resulting thereof. 4. This puppy will not be sold or given to a pet shop, puppy broker, irresponsible breeder or owner. An irresponsible breeder is defined as follows: Someone who breeds a dog solely to produce pet puppies; without regard to pedigree, quality of dog, health issues, temperament, or proper health care of their dogs. If ANY of the said criteria are met then that person is considered an irresponsible breeder. The puppy is also not be sold to an irresponsible owner, defined as follows: Someone who does not have the adequate resources to care for the dog, or has failed to care for another dog in the past. Someone who will chain the dog or treat it as an "outside pet" only. Someone who cannot or will not give the dog adequate love, care, and training. If the dog is sold to someone meeting any of these qualifications, then not only does the purchaser agree that the breeder may go and get that dog from the new owner, the purchaser agrees to be completely responsible for all of the legal ramifications resulting thereof, and they also agree to pay the breeder a fine equal to the purchase amount of the dog to the breeder. 5. The dog will be guaranteed for temperament until one year of age, meaning that the dog will not be overly aggressive. If the owner feels the dog's temperament is bad the dog will be taken to an experienced dog trainer to be tested for aggression. The dog may be returned to the breeder for a full refund before the dog reaches one year of age, unless the dog has been: A. neglected: meaning little or no human attention, little or no training. B. abused: physically or mentally C. excessively chained D. excessively crated 6. If the dog displays an illness which could be genetic, then the purchaser will take the dog to their vets and determine that the problem is genetic, at their cost. The breeder then has the option of having a vet of their choice and at their cost examine the dog, and if the breeder's vet also determines that the dog has a genetic illness, then the owner has the choice of a full refund before the dog reaches six years of age, or a replacement puppy of different lines, if such is available; or half refund if the dog is over six years of age and under twelve. If the breeder chooses not to have the dog checked by their own vet then they must abide by the owner's vet's recommendation. If the breeder's vet determines that the cause is not genetic, or that the case is unlikely to be genetic; then a third vet, acceptable to both owner and breeder, will examine the dog. The cost of this vet will be shared by both parties, and both parties will abide with this vet's recommendation. The genetic guarantee only applies to cases where it is a strong likelihood that the disease was caused by genetics. In either case the purchaser has the option of retaining or returning the dog. 7. This puppy has been carefully raised to ensure it will have the best chance to be a healthy, happy, alert, active and loving pet. The purchaser agrees to continue to provide the puppy with adequate attention, training, nutrition, veterinary care, excursive, and they will not abuse, excessive crate or excessively chain the dog (if the dog lives outside only and on a chain, this is defined as excessively chaining the dog). If they do not provide these things, the breeder reserves the right of "self-help" and may come pick up the dog and take the dog home with them on the same day. The puppy will come with the following things: 1. AKC registered. The papers will be filled out at the time of the sale and sent in by the breeder, the cost being included in the purchase price. If the AKC papers are not available when the puppy is purchased then the reason will be written below, and the papers will be sent to the purchaser before the puppy reaches six months of age and the cost of the breeder. 2. Microchipped. The $15 fee is part of the purchase price, and the paperwork is to be filled out at the time of sale. 3. Health records of shots and worming that the puppy has received by the breeder. 4. A small bag of the dog food the puppy has been eating, plus a recommended diet plan for the puppy. 5.
